Terms of Use
1. Agreement
These Terms of Use (in places also referred to as our Terms of Service) are a legal agreement between you — either an individual or the entity you represent (“you,” “your”) — and homie LLC (“Homie,” “we,” “us”), covering the Homie mobile app, the Homie website, and the related services we provide (together, the “Service”). You accept these terms when you create a Homie account. If you create an account for a band, company, or other entity, you accept on its behalf and confirm you have authority to do so.
2. The Service
Homie is software for touring artists and their teams: show schedules and day sheets, venue advance, crew coordination with per-feature permissions, guest lists with event text messaging, merch inventory and an in-person merch register, show settlement, and audience tools for fans who opt in to hear from an artist.
We may add, change, or remove features. Some features described in these terms (for example, the merch register and the audience tools) may not yet be available on your account or in your region; the same terms govern them when they become available to you.
3. Accounts and eligibility
- You will provide accurate information and keep your login credentials secure, and you are responsible for activity under your account.
- By creating an account you confirm you are at least 16 years old, and that you are at least 18 if the account purchases a subscription or connects a Stripe account.
- An account is for one touring artist or organization, which you name before creating your first tour. You agree to use your account only for that artist’s tours. Running tours for a different artist means a separate account. You can still be added to other artists’ tours as crew — that is different, and free.
- Tour owners and managers control what each team member can see and do through permission levels; inviting someone to your tour shares the data those permissions cover.
4. Your subscription
Viewing is always free: if your subscription lapses or you cancel it, you can still sign in and read your tour data, and nothing is deleted because a subscription ended. Editing and running tours requires an active subscription, billed monthly. Setting up your first tour is free; activating a tour for real use requires an active subscription.
What one subscription covers
Your account represents a single artist or organization, which you name before you create your first tour. One subscription covers every tour your account owns under that artist, however many there are. It does not extend to a second artist: tours for a different artist need their own account and their own subscription.
Working on someone else’s tour is different, and free. When another artist adds you to their tour as crew, you never need a subscription of your own and you are never charged — their subscription covers their tours. Your subscription is only ever about the tours your own account owns.
How your subscription works
Homie is a standard monthly subscription. You can subscribe on our website, or inside the iOS app:
- On the web: US $99 per month, purchased through Stripe Checkout in your browser. Your subscription renews automatically each month on your renewal date — the same day of the month you first subscribed — and the card you saved at checkout is charged, until you turn renewals off or cancel. If a month is shorter than your renewal day, you’re billed on its last day and your date returns to normal the following month.
- In the iOS app: US $114.99 per month, an auto-renewable subscription billed by Apple to your Apple ID under Apple’s own terms; the in-app price includes Apple’s in-app purchase fee. It renews monthly until you cancel it, and App Store subscriptions are managed and cancelled in iOS Settings, not inside Homie. Refunds for App Store purchases are requested from and decided by Apple, and any price change to an App Store subscription follows Apple’s own notice-and-consent process.
Both cover exactly the same service. One account needs only one subscription — if you ever hold both at once, cancel whichever you prefer.
Cancelling, refunds, and price changes
- Web subscriptions: turn renewals off or cancel anytime in the app from your Profile. Cancelling stops the next renewal; your subscription keeps working until the current period ends, and you can turn renewals back on before it does. After a lapse, restarting is always something you do yourself, through a new checkout. There are no partial refunds for unused days.
- App Store subscriptions: cancel anytime in iOS Settings (Settings → your name → Subscriptions). Access continues through the period you paid for.
- Except where the law requires one, payments are non-refundable; we may make exceptions at our discretion (for example, for a service failure or double charge). If a web subscription charge is refunded or disputed, you keep the period you paid for and the subscription simply stops at the end of it. Your data stays viewable for free either way. Refunds for App Store purchases are Apple’s decision under Apple’s policies.
- If we change the web price, we’ll email you at least one full billing period before any renewal at the new price, and where your state requires consent to a price increase, we’ll obtain it before charging the new price. Price changes to App Store subscriptions follow Apple’s consent process instead.
- Promotional codes change the price only, for the stated length of the promotion.
- The person completing checkout represents that they’re authorized to bind the account owner (or their band or company) to these terms.
- When an account’s subscription has lapsed, editing is switched off for everyone on that account’s tours, including crew, until the owner restarts it. Viewing is unaffected.
5. Guest and fan information: your responsibilities
Parts of the Service let you enter or collect other people’s information: guest-list entries with phone numbers, and fan signups at the merch table. When you do, you agree that:
- You represent and warrant that you have the person’s consent to enter their information. For guest lists, that you asked the guest and they agreed to receive event-related texts (as described here) before you entered their number, and that any consent confirmation you record in the app is true (see our SMS Policy).
- You will enter phone numbers accurately, and correct or remove entries you learn are wrong.
- You will use messaging features only for the event-related purposes they are built for, never for unsolicited or promotional messages, and in compliance with applicable laws (including the TCPA in the US and CASL in Canada).
- You will not circumvent opt-outs. When someone replies STOP or unsubscribes, that choice is final unless they opt back in themselves, and it applies across Homie: a number that has opted out is suppressed platform-wide, not just on your tour.
- Fan signups happen in the merch register, after a sale is completed: the fan enters their own email address or phone number and ticks a separate box for each one they want. Those signups belong to the artist the fan signed up for. If we ask, you will promptly tell us how a guest’s or fan’s consent was obtained. Our messaging carriers can require evidence of consent, and you agree to cooperate with those requests.
Text messages are sent from Homie’s phone number on the strength of your consent confirmation, so you agree to indemnify, defend, and hold harmless homie LLC and its officers, employees, and agents from and against any claims, damages, statutory penalties (including penalties under the TCPA or similar laws), losses, and reasonable attorneys’ fees arising out of text messages sent to a number you entered without the consent described above, or out of any untrue consent confirmation you record in the app.
Homie may refuse, delay, throttle, or suspend messaging (for an account, a tour, or the platform) at any time without liability, including to protect deliverability for everyone else or to comply with carrier requirements. Misusing messaging or contact features is grounds for suspension or termination.
6. Audience data and exports
Fans who sign up through the audience tools are sharing their contact information with the artist they signed up for. For that data, you (the artist or the account that operates the tour) are the data controller or “business,” and Homie acts as your processor or “service provider.” As your processor, Homie:
- uses audience data only to provide the Service, following what you set up and ask for in the app, and never for its own purposes;
- never sells or shares audience data, never uses it for advertising, and never uses it outside the direct relationship between Homie and you;
- never combines one artist’s audience data with another’s;
- keeps it confidential, protects it with appropriate security, and limits access to personnel and subprocessors bound by equivalent duties;
- uses only the service providers needed to run the Service — payment processing, message delivery, hosting and storage, and error monitoring;
- tells you without undue delay if it learns of a breach affecting your audience data;
- deletes your audience list when your account closes — so download anything you want to keep before you close it. We keep the consent records behind those signups, and the ones behind guest-list texts, because they are the evidence that consent was given. The Privacy Policy explains what is kept and for how long.
Exports. You can download your audience list and use it in your own tools, such as an email service. Once exported, that copy is in your hands, and you agree that you will:
- use exported audience data only for the purposes the fan agreed to: hearing from the artist they signed up for;
- comply with applicable law when contacting fans through any platform, including CAN-SPAM, CASL, and privacy laws;
- handle any unsubscribe or deletion request a fan makes to you, and provide a working unsubscribe in every message you send;
- never sell or rent the list, and never share it except with service providers acting on your behalf (like your email service);
- never use polls to ask for sensitive personal information (like health, financial details, or government IDs).
Once a list leaves Homie, the copy in your hands is yours to manage, and you are solely responsible for what is done with it, including by the services you load it into. Homie does not send messages to your audience and cannot reach into your other tools, so requests a fan makes about messages you send are yours to handle. Homie is not liable for your use of exported data or for the messages you send outside Homie. The indemnity in Section 5 also covers claims arising out of your use of exported audience data in breach of this section.
Fans are told about these commitments. Our Privacy Policy tells fans that their details are collected so the artist they signed up for can contact them, that you have agreed to the rules in this section, and that if you use their details for anything else you have broken this agreement and how you use your downloaded copy is your responsibility. You agree that we may tell them so, and that using an exported list outside the purposes a fan consented to is a breach of these terms — grounds for suspension or termination of your access.
7. Merch register, payments, and payouts
The merch register lets you take in-person card payments on your own Stripe account. Where it’s available to you:
- Card payments are processed by Stripe, Homie’s payment services provider. Card numbers go to Stripe directly; Homie never sees or stores card numbers.
- To take payments and receive payouts, you must complete Stripe’s onboarding, including identity verification, and accept the Stripe Connected Account Agreement. Your payment account is your own, and Stripe charges you a per-transaction processing fee on every card sale, billed to you directly at Stripe’s standard rates (stripe.com/pricing) and deducted from your Stripe balance. Homie adds no per-transaction fee of its own; the subscription in Section 4 is the only charge Homie itself makes. (Subscriptions purchased inside the iOS app are billed by Apple at the in-app price, as Section 4 describes.)
- You are the seller and merchant of record for everything you sell: the goods, refunds, customer service, and taxes (including sales tax) are yours. The register applies the tax rates you configure.
- Refunds and disputed charges are handled between you and Stripe under the Stripe Connected Account Agreement: Stripe debits refunded amounts, disputed amounts, and Stripe’s dispute fees from your Stripe balance, and you are responsible to Stripe for any negative balance on your account.
- You will use your real business or stage name in Stripe onboarding. It is what appears on your customers’ card statements and receipts.
- You will display the full price to customers, and will not add a surcharge for paying by card. This does not stop you from charging a service fee that applies to every sale the same way, whatever the payment method.
- You will offer every customer a receipt for their purchase.
- Tap to Pay on iPhone requires accepting Apple’s Tap to Pay terms in the app, a compatible iPhone, and location services enabled while taking payments (card networks require the device’s location to process a tap).
- Card readers are covered by Stripe’s limited hardware warranty; reader software updates are required and install automatically.
- You may only sell what Stripe’s restricted business list and the law allow. We may suspend register access for suspected misuse, fraud, or risk to Homie, Stripe, or your customers.
- Homie is a software platform, not a bank, payment processor, or money transmitter.
8. Settlement files and uploads
Settle lets you photograph or upload settlement sheets and related documents, and email settlement reports to venues. Uploads are kept with your show records, can be visible to your crew per their permissions, and are emailed to venues only at your direction.
- Never upload payment credentials. Bank account and routing numbers, wire instructions, card numbers, and images of checks must be redacted or cropped out before uploading. Uploading them violates these terms.
- You represent that you have the right to upload what you upload, and the indemnity in Section 5 also covers third-party claims arising out of content you upload or settlement emails you direct us to send.
- We may remove, redact, or quarantine files that appear to contain payment credentials or other prohibited content, but we have no obligation to review or monitor uploads.
- Settle is for keeping records of your shows. It is not intended for storing payment credentials.
- You are responsible for the accuracy of the recipients you choose when emailing settlement documents from the app.
9. Your content
Your tour data is yours. You grant Homie the license needed to host, process, back up, and display it to your team in order to run the Service, and for no other purpose. We do not sell your data or use it for advertising. If you send us feedback or suggestions, we may use them without obligation to you. See our Privacy Policy for details on how data is handled and retained.
10. Acceptable use
You will not misuse the Service. Misuse includes: breaking the law; sending spam; entering information about people without their consent; uploading payment credentials (Section 8); interfering with or probing the security of the Service; and reverse engineering the Service except where the law allows it.
11. Third-party services
Parts of the Service run on third parties with their own terms, which apply to you when you use those features: Stripe (the Stripe Connected Account Agreement for the register) and Apple (the Tap to Pay terms presented in the app, and — for subscriptions purchased in the iOS app — Apple’s Media Services Terms and Conditions). Text messages are delivered through our messaging provider under the program described in our SMS Policy. We’re not responsible for third-party services we don’t control.
12. Termination and account deletion
You can stop using Homie and delete your account at any time from the app’s settings. Deleting your account stops future renewals of a subscription purchased on our website (already-paid periods aren’t refunded). An App Store subscription is billed by Apple and is not cancelled by deleting your Homie account — cancel it in iOS Settings (Settings → your name → Subscriptions). Your data is deleted or anonymized as described in the Privacy Policy, which explains the records we must keep — sales and settlement records, and the consent records behind guest-list texts and fan signups — and how long deletion takes. We may suspend or terminate accounts that violate these terms, create risk for other users or the people they message, or where we’re required to by law.
These survive after your account is gone, because the obligations behind them outlive it: Section 5 (your duties around guest and fan information — the consent you confirmed, cooperating with proof requests, and the indemnity that rides on them), Section 6 (how audience data is handled, what happens to a list you exported, and Homie’s own duties over the copy it keeps), Section 7 (register payments, refunds, and disputes, which can surface long after a tour ends), Section 8 (settlement uploads), Section 9 (your content), and Sections 13 through 15 (disclaimers, limitation of liability, governing law and how claims are brought).
13. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-interruption. You are responsible for verifying critical information, such as settlement figures and schedules, before relying on it.
14. Limitation of liability
To the fullest extent permitted by law, homie LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues. Our total liability for any claim relating to the Service is limited to whichever is more: US $100, or one month of subscription fees. Some jurisdictions don’t allow certain limitations, so parts of this section may not apply to you.
15. Governing law and disputes
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.
Claims are brought individually. You and Homie each agree to bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. A court may not consolidate more than one person’s claims or preside over any form of class or representative proceeding. This paragraph does not apply to any claim or form of relief that the law does not permit to be waived, and if any part of it is held unenforceable, that part is severed and the rest of these terms remain in effect.
16. Changes to these terms
If we make material changes to these terms, we’ll update the effective date above and post the updated terms here. For significant changes we may also notify you in the app or by email, or ask you to accept the updated terms. Continuing to use the Service after changes take effect means you accept them.
